Definitions

In these terms and conditions, the following terms have the following meanings:

Reflection Period: The timeframe within which the consumer can exercise their right to withdraw from the agreement.

Consumer: An individual acting for personal purposes and not as part of a profession or business, who enters into an agreement with Chiggie.

Day: A calendar day.

Durable Medium: Any method that allows the consumer or Chiggie to store information in a way that enables future access and unchanged reproduction.

Right of Withdrawal: The consumer’s ability to cancel the agreement within the cooling-off period.

Chiggie: The entity offering products or services to consumers remotely.

Agreement: A formal understanding between the consumer and Chiggie, established through remote communication.

Remote Communication: Any means of concluding an agreement without the consumer and Chiggie being physically present together.

Applicability

  1. These terms apply to every offer and agreement made between Chiggie and the consumer.
  2. The terms will be made available to the consumer before entering into the agreement. If not possible, Chiggie will indicate how the terms can be accessed and provide them upon request.
  3. In case of electronic agreements, the terms will be shared in a manner that allows the consumer to store them for future reference.
  4. Any additional terms specific to a product or service will be provided clearly. In case of conflicting terms, the most favorable provision for the consumer will apply.
  5. If any provision is deemed invalid, the remaining terms will continue to apply, and the invalid provision will be replaced with one that reflects the original intent as closely as possible.

Offers

  1. Offers with limited validity or specific conditions will be clearly stated.
  2. Offers are non-binding, and Chiggie reserves the right to adjust or withdraw them.
  3. Product descriptions and images will be accurate; however, minor errors do not bind Chiggie.
  4. Offers will include:
  • Price, including taxes;
  • Shipping costs;
  • Payment and delivery methods;
  • Right of withdrawal details (if applicable);
  • Any other essential terms.

Agreements

  1. An agreement is finalized when the consumer accepts the offer and complies with its conditions.
  2. Chiggie will confirm acceptance electronically for agreements made online. Consumers can withdraw until confirmation is received.
  3. Chiggie ensures secure data handling and will implement appropriate safeguards for online payments.
  4. Chiggie reserves the right to verify the consumer’s ability to meet payment obligations. Orders may be declined or adjusted based on findings.
  5. Agreements are subject to product availability.

Right of Withdrawal

  1. Due to the perishable nature of products, returns are only accepted for incorrect or defective items.
  2. Consumers must handle products with care during the reflection period. Faulty items must be returned in their original condition and packaging.
  3. Consumers must notify Chiggie of defects or errors within 14 days of receipt.

Costs in Case of Withdrawal

  1. If a return is due to an error or defect, Chiggie will cover shipping costs.
  2. Refunds for payments made will be issued within 14 days of resolution, provided the product or proof of return has been received.

Exclusions from Right of Withdrawal

Withdrawal rights do not apply to:

  1. Custom-made products;
  2. Perishable goods;
  3. Products unsealed after delivery that cannot be returned for health or hygiene reasons;
  4. Digital content provided with consumer consent.

Payment

  1. Payment methods include credit card, iDEAL, and PayPal.
  2. Payments are processed at the time of ordering.
  3. Consumers must provide accurate payment details. Chiggie may cancel orders for non-payment.

Delivery

  1. Orders are typically shipped within 72 hours.
  2. Deliveries are limited to the Netherlands.
  3. Shipping rates are displayed at checkout and are subject to change. Consumers should review shipping details before ordering.
  4. Consumers will be notified of any delays promptly.

Warranty and Quality

  1. For defective products, contact Chiggie for a resolution.
  2. Chiggie may offer replacements or refunds at its discretion.
  3. The warranty does not cover damages caused by misuse or improper handling.

Dispute Resolution

  1. All agreements are governed by Dutch law.
  2. Disputes should first be resolved amicably. If unresolved, disputes will be submitted to the competent Dutch court.

Force Majeure

  1. Chiggie is not liable for delays or failures caused by events beyond its control, such as natural disasters or government actions.
  2. Consumers will be notified of such events and their impact as soon as possible.

Promotions and Discounts

  1. Details of ongoing promotions are available on the Chiggie website.
  2. Chiggie reserves the right to modify or withdraw promotions without prior notice. Consumers should review the offers page regularly.

Amendments to Terms

  1. Chiggie may revise these terms at any time. Updates will be published on the website.
  2. Consumers are encouraged to review the terms periodically.
